(Montgomery, Ala) – Attorney General Steve Marshall announced that the Alabama Court of Criminal Appeals affirmed the conviction of Kytwoin Mallory, 33, of Mobile, for murder. Mallory was convicted in the Mobile County Circuit Court on March 20, 2024.
The evidence at trial showed that on the night of April 6, 2021, Mercie Rees and her boyfriend, Robbie Blue, drove to a trailer in Mobile. They encountered Mallory who told them that he would give them $100.00 and drugs to take him down to the Mobile Bay. During the drive, Mallory was handling a gun and a confrontation erupted between Mallory and Blue which resulted in Mallory shooting Blue to death. Eventually Mallory released Rees who later returned to the crime scene. Several days later, police apprehended Mallory who directed them to the location of the murder weapon. At trial, Mallory claimed self-defense. That claim was rejected by the jury, and he was convicted of murder.
Mobile County District Attorney Keith Blackwood’s office successfully prosecuted this case and obtained a guilty verdict. Mallory was sentenced to twenty-five years’ imprisonment. He sought to have his conviction reversed on appeal.
The Attorney General’s Criminal Appeals Division handled the case during the appeals process, arguing for the Alabama Court of Criminal Appeals to affirm Mallory’s conviction. The Court did so in a decision issued Friday, August 15, 2025.
Attorney General Marshall commended Assistant Attorney General Beth Slate Poe for her successful work on this case and thanked District Attorney Keith Blackwood and his staff, for their valuable assistance in defending the murder conviction.
